OFFICIAL RULES
NO PURCHASE NECESSARY TO ENTER OR WIN – A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. MUST BE 21 YEARS OF AGE OR OLDER TO ENTER. INTERNET ACCESS AND VALID EMAIL ADDRESS REQUIRED. SWEEPSTAKES AVAILABLE ONLY IN CT, MA, ME, NH, NY, RI, VT.
SWEEPSTAKES PERIOD: Woodchuck Hit the Slopes Sweepstakes (“Sweepstakes”) begins November 1, 2015 and ends March 31, 2016 (“Sweepstakes Period”). All entries must be received by 11:59 PM (EST) March 31, 2016.
ELIGIBILITY: NO ALCOHOL PURCHASE NECESSARY TO ENTER OR CLAIM PRIZE. Sweepstakes is open only to permanent, legal residents of the United States (“U.S.”) in Connecticut, Massachusetts, Maine, New Hampshire, New York, Rhode Island, or Vermont, who are at least twenty-one (21) years of age as of the time of entry, with access to the Internet at all times during the Sweepstakes Period (as defined above). Employees, officers, directors, managers, members or agents of Woodchuck Cidery (“Sponsor”), Ski Vermont, Vermont Ski Areas Association, and all associated agencies and each of their respective parent corporations, subsidiaries, affiliates, sales representatives, distributors, licensees, prize providers or agents, and all of their respective officers, directors and employees (all of the foregoing, together with Sponsor collectively, “Sweepstakes Entities”), and their immediate family members (spouse, parent, child, sibling and their respective spouses) and those living in the same household of each (whether legally related or not), are ineligible to enter or win the Sweepstakes. All applicable federal, state and local laws and regulations apply. Void where prohibited by law. No purchase necessary to enter or win. A purchase or payment of any kind will not increase your chances of winning. Entry in the Sweepstakes constitutes your full and unconditional acceptance of these Official Rules.
HOW TO ENTER: To enter, go to https://www.woodchuck.com/hittheslopes (“Website”) and complete and submit the official entry form (“Entry”). All entries (i.e., official entry form) must be received between 12:00 AM (EST) on November 1, 2015 and 11:59 PM (EST) on March 31, 2016. You may enter as many times as you like however, entries are limited to one entry per person per day. An e-mail address may only be used by a single person to enter Sweepstakes. Sponsor will not verify receipt of entries. In case of dispute, entries will be declared made by the authorized account holder of the e-mail address submitted at the time of entry. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet Access Provider, on-line service provider, or other organization (e.g., business, educational institution, etc.) or phone service provider that is responsible for assigning e-mail addresses or phone numbers for the domain associated with the submitted e-mail address. Entry information must be manually key-stroked. Automated entries are prohibited, and any use of such automated devices will cause disqualification. Sponsor is not responsible for lost, late, illegible/garbled, corrupted, irregular, misdirected or stolen entries or transmissions, or problems of any kind whether mechanical, human or electronic; and, all such affected entries are void. Sweepstakes entries are the property of Sponsor and will not be acknowledged or returned. Proof of transmission does not constitute proof of receipt or proof of Sweepstakes entry.
PRIZE DETAILS: Five (5) Grand Prizes of Two (2) Single Day Ski Passes to a Vermont Ski Resort to be determined by sponsor (ARV $200 per pair). One (1) prize will be awarded each month, November 2015 through March 2016.
Prize cannot be transferred, substituted or redeemed for cash except at Sponsor’s sole discretion. Federal, state and local taxes (if any) are the sole responsibility of the winner. Sponsor reserves the right to substitute a prize with a prize of equal or greater value. Only one prize per family or household.
SELECTION OF WINNERS: Winners will be selected via a random drawing (“Drawing”) on the first day of each month beginning December 1st, 2015 with the last winner being selected April 1st, 2016. The Drawing will consist of only eligible entries received up to and including the last day of the month prior to Drawing date. Non-winning entries from prior drawings will not be retained after each monthly Drawing for the subsequent monthly drawings.
The Drawing will be conducted by Sponsor, whose decisions are final and binding in all respects. Odds of winning depend upon the number of eligible entries received for each monthly Drawing. Entries initially selected as potential winners of the Sweepstakes will be notified on the drawing date. If a potential winner cannot be contacted despite reasonable efforts to do so, as determined by Sponsor’s sole discretion, or if potential winner declines prize, then such person shall be disqualified and an alternate winner will be selected from among all remaining eligible entries received for the random drawing.
CLAIMING YOUR PRIZE: Winners will be required to sign and return to Sponsor a notarized Affidavit of Eligibility and Liability/Publicity Release (“Winner Affidavit/Release”) within three (3) days of being notified. Non-compliance within this time period may result in disqualification and an alternate winner will be selected. At the sole discretion of the Sponsor, disqualification, forfeiture and the selection of an alternate potential winner may result from any of the following: (1) a potential winners failure to respond to potential winner notification within twenty-four (24) hours of its transmission; (2) the return of potential winner notification as undeliverable after two (2) attempts; (3) a potential winners failure to provide Sponsor with a signed and notarized Winners Affidavit/Release within twenty four (24) hours of transmission; (4) winner declines to accept prize; and (5) any other non-compliance with these Official Rules.
GENERAL RULES: By entering or participating in the Sweepstakes, entrants agree to be bound by these Official Rules, the terms and conditions of the Sweepstakes Entities’ websites, and by the decisions of Sponsor, which are final and binding in all respects. Sponsor reserves the right to modify these Official Rules for clarification purposes without materially affecting the terms and conditions of the Sweepstakes. Sweepstakes Entities are not responsible for: (a) lost, late, illegible/garbled, corrupted, irregular, misdirected or stolen entries or transmissions; (b) any incorrect or inaccurate information or technical failures of any kind; (c) unauthorized human intervention in any part of the entry process or the Sweepstakes; or (d) any other computer, network, technical, human or other error, problem or malfunction that may occur in connection with the administration of the Sweepstakes, the processing of Entries, or the selection or notification of Winner. Further, if, for any reason, the Sweepstakes is not capable of running as planned for reasons outside the control of the Sponsor which, in the sole opinion of Sponsor, may corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes (or portion thereof), Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes (or portion thereof). In the event of such cancellation, termination, modification or suspension, Sponsor may select the Winners from all eligible, non-suspect Entries received prior to such action. Sponsor also reserves the right to disqualify the Entry of any individual if, in its sole discretion, it determines that said entrant is (a) attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or other unfair playing practices, including without limitation, tampering or attempting to tamper with the entry process or the operation of the Sweepstakes or any website operated by the Sweepstakes Entities and/or using or attempting to use any robotic, macro, automatic, programmed or like entry methods; (b) violating these Official Rules or the terms of service, conditions of use, and/or general rules of any Sponsor property or service; or (c) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten, or harass any other person.
ADDITIONAL TERMS: By entering, participants agree to release and hold harmless the Sweepstakes Entities from and against any and all losses, damages, rights, claims, actions and liabilities of any kind in connection with the Sweepstakes or receipt or redemption of a Prize.
CAUTION: ANY ATTEMPT BY AN ENTRANT TO UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY’S FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
DISPUTES: Any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration. Any and all disputes relating to this Sweepstakes or any prize shall be subject to the internal laws of the State of Vermont and the exclusive jurisdiction, forum and venue shall be in the state or federal courts located in Vermont. The remedy for any claim shall be limited to actual damages and in no event shall any party be entitled to recover punitive, exemplary, consequential or incidental damages, including attorneys’ fees or other such related costs of bringing a claim or to rescind this agreement or seek injunctive or any other equitable relief.
